User agreement
Basic definitions of the Agreement:
- Administration of the Website
- shall mean the service, which develops and maintains the InkaFilm Internet resource (located at www.inkafilm.ru).
- User
- shall mean a natural person or a legal entity, which agrees to enter into this User Agreement.
- Guest
- shall mean a user who is not registered with the Website. Guests are allowed to visit this Website and watch any video, posted on it.
- Registered User
- shall mean a User, who obtains expanded possibilities within the Website. Only Registered Users are permitted to estimate and to publish their comments to the video, as well as to maintain a personal list of selected video.
- User name
- shall mean a unique name of a User on the Website, which should consist of from 2 to 20 symbols. Latin lowercase letters, numbers and the “_” symbol are allowed.
- User registration
- shall mean a procedure of the selection by the Guest of a free and allowable User name with the password and the appellation for the authorized access to the Website. The password and the activation code shall be sent to the e-mail submitted by the Guest.
- User name activation
- shall mean the final stage of the User registration, at which the chosen User name is to be assigned to the User. The Guest shall hold the User name within a 24-hour period and if the User name is not activated within this period it shall become available for any other users.
- Authorization
- shall mean the access to the Website by entering the User name and the password.
- Password renewal/change
- shall mean the request for a new password to get an authorized access to the Website. The new password shall be sent to the e-mail submitted by the User at the registration.
- Password activation
- shall mean a User’s approval of the request to change the password. New password activation is available during 24 hours after the appropriate request. Once said period has expired and the activation is not performed the old password shall stay valid.
1. General terms and conditions
1.1. This is the User Agreement between the Administration of the Website (“Administration”) and the User, which settles relationship on the Website use located at www.inkafilm.ru.
1.2. This Agreement shall become effective upon the moment, when the User sends the filled registration form.
1.3. The Administration retains the right to modify and revise this User Agreement in its sole discretion. Such modifications shall become effective upon their publication on the Website.
1.4. If the User objects to any terms of the modified or revised User Agreement he must discontinue his registration with the Website and leave it immediately.
1.5. It is advisable to allow the use of Cookies and turn on JavaScript in the browser installation-specific settings to work with the Website. You will have to install a Flash Player (version 8 or a later one).
1.6. All audio-video material available on this Website is placed in strict compliance with the observance of copyright, based on the agreements with the authors or the companies, which own the rights for this works.
1.7. Registration with the Website allows estimating and publishing of the comments to the video, as well as to maintain a personal list of selected video.
2. Indemnity and liabilities of the Administration
2.1. The Administration grants the User the right to use the Website for private purposes.
2.2. The Administration shall maintain the access to the Website on a 24-hours and 7-day basis, without interruption, except for the preventive maintenance work. The Administration is authorized to carry out the preventive maintenance work without prior notice of the User.
2.3. The Administration renders the use of the Website as it is available at the moment of its rendering, at the same time the Administration makes no direct or indirect guarantees.
2.4. The Administration makes no guarantees, that the software or the texts presented on the Website will correspond with the requests or expectations of the User, neither the Administration guarantees that the software contains no mistakes and will functionate without fail. The Administration makes no guarantees that the received via the Website software or any other materials do not contain viruses and other harmful components.
2.5. The Administration is not responsible for the content of the published comments of the Users and for possible this connection consequence.
2.6. The Administration is not responsible for any claims of any third parties.
2.7. The Administration is not responsible for any damage, caused to the User resulting from using the Website in purposes, which differ from those the service was provided for.
2.8. The Administration will have no responsibility for the impossibility to use the Website or for the lack of productiveness of the software for any reasons not depending on the Administration.
2.9. The rejection or suspension of the access to the Website can be caused by the following circumstances:
- the security and defense threat of the state, health and human lives;
- in case of physical, topographical and other natural obstacles;
- if the User is involved in the activity, which the Administration in its sole discretion shall consider as breaching this Agreement. At the same time the Administration shall have no obligation to any third parties for the notification of the deprivation of the User of the access to the Website and for any possible consequences resulting from the lack of such notice;
- if the User does not accept these terms of the access providing to this Website;
- if the User refused to submit his personal data or being fully aware provided false information about himself;
- if the User uses the Website for any purposes, which violate the laws of Russian Federation or the International law;
- if the User has violated this Agreement earlier before;
- at the force majeure circumstances (war, civil strife, epidemics, acts of God and etc.).
2.10. The Administration reserves the right to cancel from its servers any information or materials, which in full or in part in the Administration’s sole discretion are unsuitable, objectionable or which breach this Agreement.
2.11. The Administration reserves the right to correct grammatical mistakes in the comments of the Users and to conceal messages containing the obscene language or expressions which may humiliate the honor and dignity of the representatives of the Website, the authors or the Users. The Administration may limit the authorized access to the Website for the User in case of such violations.
3. User’s Rights and Liability
3.1. The User is solely responsible for keeping his password secure.
3.2. The User shall have the right to use the Website in his sole discretion at any time, without any violations of this Agreement and in non-commercial purposes only.
3.3. The User who is not satisfied with the Website, terms, rules, quality of its content or the practice or providing the Website has his exclusive right to discontinue using of the Website.
3.4. The User shall have an obligation not to attract the Administration to be a respondent or an advisor on any liabilities or expenses in connection with the infringement of this Agreement by the User or any other parties, using his login and password.
3.5. The using of the obscene language on the Website is expressly forbidden.
3.6. The User is prohibited to limit the access or to hinder other Users from using the Website.
3.7. It is prohibited to make an unauthorized interfere to any technical links, programs, databases and other composing elements of the Website.
3.8. It is forbidden to distribute, send and make available any information, the distribution of which is conflict with the Russian or International law.
3.9. It is forbidden to transfer any software/information containing viruses and other harmful components.
3.10. It is prohibited to use the software, other materials and any information of the Website in any commercial purposes, unless they are permitted and accepted by the Administration in written.
3.11. It is forbidden to copy, to display, to transfer and to translate to other languages any parts of the Website without the Administration’s permission.
4. The User Agreement coming into effect
The User Agreement in any single case comes into effect at the User’s confirmation of his acceptance of its terms and conditions by means of registration at www.inkafilm.ru.
